General Terms & Conditions (GTC)

of Snowsports Company Kaprun GmbH & Co KG
(“Snowsports Company Kaprun”)

1. Scope of Application

1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all business relationships between Snowsports Company Kaprun GmbH & Co KG, Hauserdorfstraße 4, 5710 Kaprun, Austria (“Snowsports Company Kaprun”), and any customer or participant (“Customer”) booking courses, training, or related services (“Course” or “Services”).
1.2 The version of these GTC in force at the time of booking shall apply.
1.3 Deviating, contradictory, or supplementary conditions of the Customer shall not apply unless expressly confirmed in writing by Snowsports Company Kaprun.

2. Subject of Contract

2.1 The subject of contract is the provision of snowsport instruction, guiding, and related services in accordance with Austrian ski-school regulations.
2.2 The Courses may include ski and snowboard lessons, technical training, instructor training, or guided off-piste activities. Lift passes, travel, and equipment are not included unless expressly stated.
2.3 Snowsports Company Kaprun undertakes to provide instruction by appropriately qualified personnel in accordance with the Salzburger Skischulgesetz and current safety standards.

3. Conclusion of Contract

3.1 A contract is formed upon receipt of a written or electronic booking (via website, e-mail, or direct registration) and subsequent written confirmation from Snowsports Company Kaprun.
3.2 Payment of the course fee constitutes acceptance of these GTC.
3.3 Bookings are subject to availability and may be refused if capacity limits or safety regulations require.

4. Prices, Payment & Administration Fees

4.1 All prices are quoted in Euros (€) and include applicable Austrian VAT unless otherwise stated.
4.2 Payment can be made by credit card, debit card, or bank transfer. Personal cheques and American Express are not accepted.
4.3 Payments made by card are subject to a processing fee of 2.99% for EU cards and 3.9% for non-EU cards.
4.4 The total course fee is due upon confirmation of booking unless otherwise agreed in writing.
4.5 Snowsports Company Kaprun reserves the right to suspend participation in training in the event of non-payment.
4.6 In the event of delayed payment, statutory interest and reasonable administrative costs may be charged.

5. Taxes

5.1 All applicable taxes are included at prevailing Austrian rates. Should tax regulations change, any adjustments will be passed on to the Customer.

6. Withdrawal & Cancellation by the Customer

6.1 Cancellations are only effective if in writing by e-mail to:

Cancellations are effective upon confirmed receipt.
6.2 Cancellations made 60 days or more before the course start date: 50% refund of total cost (excluding deposits and administration fees).
6.3 Cancellations within 60 days of the course start date: no refund (deposit forfeited).
6.4 Deposits are non-refundable and non-transferable.
6.5 In case of illness, accident, or injury, a partial refund or course credit may be granted upon presentation of a medical certificate from a licensed doctor within 3 days of cancellation.
6.6 Refunds, where due, will be processed within 21 days using the same payment method.
6.7 No refund is given for non-attendance or early withdrawal during an ongoing course.

6.8 Quarantine / COVID-19 / Epidemic Clause
If official travel restrictions, quarantine requirements, or epidemics/pandemics (e.g. COVID-19) make participation impossible, the Customer may withdraw under the following conditions:

a) Compulsory quarantine ≤ 3 days: Customer pays a 25 % cancellation fee; 75 % refunded.
b) Compulsory quarantine 4–5 days: Customer pays 50 % cancellation fee; 50 % refunded.
c) Compulsory quarantine > 5 days or official travel ban: Full refund of unused portion of the course.

If quarantine or restrictions were already known at the time of booking, this clause does not apply.

7. Cancellation or Modification by Snowsports Company Kaprun

7.1 Snowsports Company Kaprun makes every effort to operate all lessons as scheduled. However, it reserves the right to modify, postpone, or cancel lessons in cases of insufficient participants (fewer than 4 per group), instructor illness, safety concerns, or other operational reasons. Group courses require a minimum of 4 participants. If this minimum is not reached, Snowsports Company Kaprun reserves the right to combine groups or cancel with a proportional refund.
7.2 If significant changes affect the service, the Customer will be notified promptly and offered the following options:

  • (a) Accept the modification,
  • (b) Transfer to an alternative course of equal value, or
  • (c) Cancel and receive a full refund.
    7.3 For minor changes that do not substantially alter the service, Snowsports Company Kaprun is not obliged to offer compensation.

8. Force Majeure & Impossibility of Performance

8.1 Snowsports Company Kaprun may cancel or curtail services without liability if external events make safe operation impossible — including but not limited to:
adverse weather, avalanche risk, lift closures, war, strikes, pandemics, official restrictions, power failures, or natural disasters.
8.2 In such cases, Snowsports Company Kaprun will issue a proportional refund or credit for the unused portion of the booking.
8.3 Refunds due to force majeure will be processed within 21 days of confirmation.
8.4 No further compensation is due for consequential losses.

8.5 Snowsports Company Kaprun is not responsible for lift operations, transport, or accommodation.

9. Liability & Insurance

9.1 Snowsports Company Kaprun is not liable for accidents, injury, loss, or damage unless caused by gross negligence or wilful misconduct of its employees.
9.2 Liability for financial or consequential loss is limited to three times the course fee.
9.3 Customers participate entirely at their own risk and are responsible for adequate accident, medical, rescue, and liability insurance.
9.4 Customers are advised to wear a helmet and, where applicable, carry appropriate safety equipment (e.g. avalanche transceiver).
9.5 Rescue or helicopter evacuation costs are at the participant’s expense unless caused by gross negligence of Snowsports Company Kaprun or its agents.
9.6 Snowsports Company Kaprun is not liable for damage caused by the Customer to themselves, other participants, or third parties during the execution of the service.

10. Customer Obligations

10.1 Customers must truthfully inform Snowsports Company Kaprun of their skiing or snowboarding ability and any relevant health conditions.
10.2 Customers must ensure their equipment is professionally checked (especially ski binding settings) before lessons.
10.3 Customers must follow all instructions given by Snowsports Company Kaprun staff. Failure to do so may result in exclusion from lessons without refund.
10.4 Customers are responsible for providing details of any allergies or medications that could impact their safety.
10.5 Travel to and from lesson meeting points is the responsibility of the Customer.

11. Data Protection

11.1 Snowsports Company Kaprun processes personal data in compliance with the EU General Data Protection Regulation (GDPR).
11.2 Data is collected and used only for legitimate business purposes and never shared with third parties unless legally required.

12. Media Use

12.1 Snowsports Company Kaprun reserves the right to use photographs, videos, and other media material of participants for promotional purposes unless the Customer requests otherwise in writing.

13. Governing Law & Jurisdiction

13.1 These Terms and Conditions and all related agreements are governed by Austrian substantive law, to the exclusion of private international law and the UN Convention on Contracts for the International Sale of Goods.
13.2 The place of fulfilment and exclusive jurisdiction for all disputes shall be Zell am See, Austria.
13.3 Snowsports Company Kaprun encourages amicable resolution and may suggest mediation before legal proceedings.

14. Qualification Statement

14.1 All instructors are qualified in accordance with Austrian Snowsport Instructor Law (ÖSSV) and hold valid SBSSV/WSSV or equivalent certification set to either ISIA or Commission Delegated Regulation (EU) 2019/907 of March 14th 2019 for the establishment of a joint training examination for ski instructors in accordance with Article 49b of Directive 2005/36 / EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications.

15. Final Provisions

15.1 There are no supplementary verbal agreements. Any modifications or additional agreements must be made in writing.
15.2 If individual provisions of these GTC are or become invalid, the remaining provisions shall remain in effect.
15.3 All rights and obligations under these GTC transfer to any legal successors of Snowsports Company Kaprun.
